2. Acceptance of terms

By using our website or instructing us to carry out any service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or engage our services. You must be at least 18 years of age to use our website or engage our services. By proceeding, you confirm that you have the legal capacity to enter into this Agreement.

3. Description of services

Sathaphon Legal provides the following services to clients in Thailand:

• ■ Living Will and Directive Preparation (4,600 THB per engagement)
• ■ Lifetime Gift Documentation (7,800 THB per engagement)
• ■ Lifetime Estate Plan with Annual Review (14,000 THB per year)

The scope of each service is described on our website and confirmed in writing at the start of each engagement. We do not provide services in areas of law other than inheritance and estate matters. Nothing on our website constitutes legal advice — legal advice is provided only following a formal engagement.

4. User responsibilities

When using our website or engaging our services, you agree to:

• ■ Not attempt to gain unauthorised access to any part of our website or systems.

5. Intellectual property

All content on this website, including text, design, and structure, is the property of Sathaphon Legal and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive licence to access and use the website for personal, non-commercial purposes. You may not reproduce, copy, distribute, or exploit any content from this website for any commercial purpose without our prior written consent.

6. Payment terms

The fees for our services are fixed as stated in Section 3 and confirmed in writing at the start of each engagement. Payment is due upon confirmation of the engagement and may be made by bank transfer to the account details provided in the engagement confirmation. Fees are payable in Thai Baht (THB). No work will commence until payment has been received. For the annual review arrangement, fees are invoiced at the beginning of each annual cycle.

7. Refunds and cancellations

If you cancel an engagement before any work has commenced, we will return the fee in full. If work has commenced, we will apply a reasonable charge for work completed to that point and return the balance. No refund is available after a document has been finalised and signed. For the annual review arrangement, fees are not refundable after the annual review meeting has taken place.

To the fullest extent permitted by Thai law, our liability to you arising out of or in connection with these terms or our services is limited to the fees paid by you for the specific engagement in which the liability arises. We are not liable for indirect, consequential, or special losses. Nothing in these terms limits our liability for fraud, personal injury caused by negligence, or any liability that cannot lawfully be excluded.

10. Confidentiality

We treat all client information as confidential and will not disclose it to any third party without your instruction, except where required by Thai law or by a competent authority. You agree that information you share with us in connection with an engagement may be used by the firm for the purpose of providing the services you have requested.

11. Termination

Either party may terminate an engagement by written notice. If we terminate an engagement, we will apply a reasonable charge for work completed to that point and return the balance of any fees paid. If you terminate an engagement, Section 7 (Refunds and cancellations) applies. Provisions relating to confidentiality, intellectual property, limitation of liability, and governing law will survive termination.

12. Governing law and dispute resolution

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with these terms or our services shall first be referred to informal resolution between the parties. If informal resolution is not achieved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

13. General provisions

These Terms and Conditions, together with any written engagement confirmation, constitute the entire agreement between us in relation to the services. If any provision is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce any provision does not constitute a waiver of that provision. You may not assign your rights under this Agreement without our written consent.

14. Changes to these terms

We may update these Terms and Conditions from time to time. We will update the "last updated" date at the top of this page when changes are made. We recommend reviewing this page periodically. Continued use of our website or services after any change constitutes acceptance of the revised terms.
